Terms of Service

1. Scope & Provider

These General Terms and Conditions (AGB) govern the use of PackLite, a hiking gear management web application operated by Brian Patrick Douglas, Hügelistrasse 5, 9535 Wilen bei Wil, Switzerland. By creating an account you agree to these terms.

2. Service Description

PackLite provides a multi-user platform for managing hiking gear inventories and trip planning. The service is available via the internet at the applicable domain. A free tier with limited features and paid subscription plans are offered.

3. Registration & Account

  • You must provide a valid email address and a password of at least 6 characters.
  • You are responsible for maintaining the confidentiality of your credentials.
  • Each person may hold only one free account.
  • You must be at least 16 years old to use this service.
  • Accounts used to harm others, for spam, or for illegal purposes will be suspended.

4. Subscription Plans & Payment

  • Paid plans (Pro, Team) are billed monthly or annually as selected at checkout.
  • Prices are shown in USD and are exclusive of any local taxes (VAT/MWST) where applicable.
  • Payments are processed securely by Stripe, Inc. We do not store payment card details.
  • Subscriptions renew automatically unless cancelled before the next billing date.
  • You may cancel at any time via the billing portal; access to paid features continues until the end of the paid period.

5. Right of Withdrawal (Widerrufsrecht)

As the service is a digital product that is made available immediately upon purchase, and you expressly consent to early performance at checkout, the right of withdrawal (OR Art. 40a ff.) for distance contracts is excluded once access to the paid features has begun. Refunds may be granted at the operator's discretion in cases of technical failure on our side.

6. Free Tier Limitations

Free accounts are subject to usage limits as displayed in the application. The operator reserves the right to change free-tier limits with 30 days' notice.

7. Intellectual Property

All software, design, and text comprising PackLite are protected by copyright and belong to the operator or their licensors. Your gear and trip data remains your property. You grant the operator a limited licence to store and process your data solely to provide the service.

8. Open-Source Components

PackLite is built on Ruby on Rails and other open-source libraries. Third-party licences (MIT, Apache 2.0, etc.) are available in the project's Gemfile.lock and via the respective upstream repositories. These licences are fulfilled; no additional obligations are imposed on end users.

9. Availability & Maintenance

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance where possible. The operator is not liable for losses caused by temporary unavailability.

10. Limitation of Liability

To the maximum extent permitted by Swiss law (OR Art. 100), the operator's liability is limited to direct damages and excludes indirect, incidental, or consequential losses. Liability for gross negligence and wilful misconduct cannot be excluded. Total liability shall not exceed the fees paid by you in the 12 months preceding the claim, or CHF 100 for free accounts.

11. Data Protection

The processing of personal data is described in our Privacy Policy. By accepting these terms you also acknowledge the Privacy Policy.

12. Amendments

The operator may amend these terms with 30 days' notice by email. Continued use after the effective date constitutes acceptance. If you disagree, you may terminate your account before the new terms take effect.

13. Termination

Either party may terminate the agreement at any time. The operator may suspend or delete accounts that violate these terms without prior notice. Upon termination, your data will be deleted in accordance with the Privacy Policy.

14. Governing Law & Jurisdiction

These terms are governed by Swiss law, excluding conflict-of-law provisions. The exclusive place of jurisdiction for disputes is Frauenfeld, Switzerland, Switzerland, subject to mandatory statutory exceptions (e.g. consumer protection under ZPO Art. 32).
